Terms and conditions

These terms govern your use of this website and your membership with Fidere. They explain who we are, what we provide, what we do not provide, and the rules that apply to the relationship between you and us.

1. Who we are

This website and the Fidere Men's Health service are operated by Fidere Clinic (Pty) Ltd, a private company incorporated in the Republic of South Africa.

In these terms, "Fidere", "we", "us" and "our" mean Fidere Clinic (Pty) Ltd. "You" and "your" mean the person using this website or holding a Fidere membership.

2. Accepting these terms

By using this website, submitting an enquiry, or taking up a Fidere membership, you accept these terms. If you do not accept them, please do not use the website or the service.

We may update these terms. The version published on this page is the version that applies. Where a change materially affects members, we will give at least 30 days notice by email before it takes effect.

3. What Fidere provides

Fidere is a private, clinician-led health service for men. A membership gives you:

  • An initial private consultation and a clinical assessment.
  • A personalised health plan built around the health areas included in your membership tier.
  • Recommendation and interpretation of appropriate diagnostic testing.
  • Ongoing clinical contact, review and monitoring at the cadence of your membership tier.
  • Access to your health information through the Fidere member platform.

Two membership tiers are offered. Foundation covers the essential health baseline. Apex adds deeper diagnostic analysis, genetics and longevity insight, a higher clinical cadence and closer monitoring. The scope of each tier is described on our memberships page and is confirmed to you in writing before you join.

4. What is not included

Paid separately

Laboratory tests, imaging, other third-party investigations and prescribed medication are not included in the membership fee. They are quoted and billed separately. Fidere recommends appropriate testing, analyses the results and develops your treatment plan. Medication is prescribed only where it is clinically appropriate.

Fidere is not a medical scheme, a health insurer or a medical scheme administrator. Membership is not medical cover and does not pay for or reimburse healthcare costs. Fidere is not registered under the Medical Schemes Act, 1998.

5. Fidere is not an emergency service

Fidere does not provide emergency care. If you have a medical emergency, call 10177 for an ambulance or 112 from a mobile phone, or go to your nearest emergency department immediately. Do not use this website, the member platform or email to report an emergency.

6. Information on this website is not medical advice

The content on this website is general information. It is not a diagnosis, a treatment recommendation or a prescription, and it does not create a doctor and patient relationship. Treatment is decided only by a qualified clinician after an appropriate assessment of you as an individual.

Nothing on this website should be relied on to delay seeking care from a qualified healthcare professional.

7. Who may become a member

  • You must be 18 years or older.
  • You must have legal capacity to enter into a contract.
  • Membership is offered at our discretion. We may decline an application, including where we judge that Fidere is not clinically appropriate for you.

8. Your responsibilities

  • Give us complete and accurate health information. Clinical decisions depend on it.
  • Tell us promptly if your health, medication or circumstances change.
  • Keep your member platform login details confidential and tell us at once if you think they have been misused.
  • Attend booked appointments, or cancel within the notice period in our fees, payment and refunds policy.
  • Pay all fees when they are due.

9. Clinical independence

All clinical decisions are made by a registered clinician exercising independent professional judgement, in line with the rules of the Health Professions Council of South Africa and the Medicines and Related Substances Act, 1965. A clinician may decline to prescribe or to recommend a treatment where it is not clinically appropriate. Paying a membership fee does not entitle you to any particular test, treatment or prescription.

10. Fees and payment

Fees, billing, cancellation and refunds are dealt with in full in our fees, payment and refunds policy, which forms part of these terms.

11. Your personal information

How we collect, use, share and protect your personal and health information is set out in our privacy policy, which forms part of these terms and is written to comply with the Protection of Personal Information Act, 2013 (POPIA).

12. Intellectual property

The Fidere name, logo, website, member platform, written content, protocols and reports are owned by Fidere Clinic (Pty) Ltd or its licensors. Your health records and the personal information in them remain yours. You may use your own reports for your own purposes. You may not copy, republish or commercially exploit our content without our written permission.

13. Limits on our liability

Nothing in these terms limits any liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, for fraud, or any right you have under the Consumer Protection Act, 2008.

Subject to that, we are not liable for indirect or consequential loss, loss of profit, or loss arising because you relied on general website content instead of an individual clinical assessment. We are not liable for the acts or omissions of independent third parties such as laboratories, pharmacies, imaging providers or specialists to whom you are referred.

14. Third parties

We work with laboratories, pharmacies, imaging providers and specialists. Where you are referred to one, your relationship for that service is with that provider, on their terms. We choose partners carefully but we do not control them.

15. Ending the relationship

You may cancel your membership in line with our fees, payment and refunds policy. We may suspend or end a membership where fees are unpaid, where these terms are seriously or repeatedly breached, where behaviour towards our staff is abusive, or where continuing would be clinically inappropriate or unsafe. Where we end a membership we will refund any fee paid for a period not yet used, and we will help you transfer your records to another provider.

16. Complaints

If something goes wrong, tell us. Our complaints route and timelines are on the contact page. You also have the right to complain to the Health Professions Council of South Africa about clinical conduct, and to the Information Regulator about the handling of your personal information.

17. Governing law

These terms are governed by the law of the Republic of South Africa. The courts of South Africa have jurisdiction. If any clause is found to be unenforceable, the rest of the terms continue to apply.

18. Electronic communications

The information required by section 43 of the Electronic Communications and Transactions Act, 2002 is set out in section 1 above and on the contact page. You agree that we may communicate with you electronically and that electronic communications satisfy any legal requirement that a communication be in writing.
